demanning a half million bail. the family was pleading for help and the details are still coming in. we hope to bring you a live report today later in the bay. in the meantime it's 5:01 and we want to check the forecast and welcome jennifer hill this morning. good morning. >> good morning and thank you. a little cool yesterday, but today things start to warm up. we have the low clouds hugging the area and those will burn off by the time we reach the noon hour. by noon we are getting to the 60s and 70s and by 4:00, upper 70s for fairfield and livermore. in the 60s over san francisco and santa cruz. >> sounds like a great day. let's see how your commute is shaping up. as a view across the bay, looking nice right now. westbound with the tail lights away from the hayward side where the construction picked up off the southbound 80 and 82

interchange. good news for city streets. let me show you the maps. we have construction schedule and that has been going on for a while. we do have a couple of lanes block until about 7:00 a.m. southbound 280 moving smoothly and that won't start until later on until about 6:30. back to you. >> 5:02 right now. the search continues for four people still missing after the explosion in san bruno. at the same time the search for answers into what sparked the has emotions running high. bob is live in san bruno with more on the questions and the answers. good morning, bob. >> good morning to you, laura. the ntsb revealed new information about the gas point line that ruptured in the crater down here where we are standing in san bruno. information that could be crucial to the investigation. it turns out that the section of 30 inch steel pipe had several

wells in it. they pieced it together so it could make a curve and fit the terrain. one of the wells was a clean end of the pipe where you could see a very sdrinkt clean break at the weld. we will see whether that was a defect and the other end of the type was torn and shredded and much less clean. >> that section is now on the way to a lab in washington, d.c. for further analysis. they said now it's on to reviewing video shot by residents and caught by surveillance camera. here's video from the gasoline station a few blocks away. the ntsb obtained this. the video shows customers

turning their heads towards a whooshing sound. then debris followed by the massive fireball. it shows police arriving within a minute and a half. the ntsb will interview residents and other witnesses. they said it has received reports from people who live in the area about the smell of gas in the days leading up to the explosion, but so far they have not been able to find evidence that someone notified pg&e or 911 about this. live in an bruno, bob redell at the bay. >> friends and neighbors are working to build each other up. people like harley are dealing with a lot. his friend and their parents have not been found. he is among a group of people now looking for this family. >> it's unnerving because i want to know what happened to my friend or if they are there and they were lost in the system and remains have not been found. we have hope that they are okay.

>> william, greg, andula von have not been found. they were members of the presbyterian church and church members have also joined the search for them. >> survivors are getting their first looks at their destroyed or damaged homes. police led bus loads of victims in on monday. they say there were a lot of tears on board. families like this who live on glenview for 50 years and found their home destroyed. bob henzle got a look at what used to be his home. he escaped in a car. pg&e set up a fund to help the victims rebuild. it's pledging to immediately issue checking of up to $50,000 to help affected residents get started. pg&e gave $3 million to the city to fix streats and sidewalks damaged by the explosion. they said the fund has no strings attached. >> pg&e's response to future

disasters could be hampered by the agency that regulates it and you, the taxpayer could be holding the bag. live in san bruno with a proposal to create a so-called wildfire expense balancing account. what's that all about? >> that is the official name of the proposal, but likely a lot of folks here are going to call it insult to injury. it would trigger a rate hike after a disaster like this one that happened in san bruno. in this disaster, pg&e said they have the money to cover the insurance deductible which is $10 million and that's related to the pipeline disaster. they could seek a rate hike to cover the cost could change that and make a rate hike automatic. this is an idea floated by san diego gas and electric a few years back after the billion

dollar fires there. those were massive fires fuelled by terrible fire weather and had really it is to do with the utility itself. under this proposal that they will discuss today, any fire larger than an acre account trigger a rate hike. the reason suggest it's getting harder and harder for utilities to find insurance and harder and harder for them to afford it. today's discussion is of the first steps, but it could trigger a vote by the commission next year. back to you. >> thanks a lot, chris. stay with us for continuing coverage of the san bruno explosion. you can get the latest on from our website. >> a reward is offered to help for the person who set fire to a san jose elementary school. firefighters will donate a $10,000 reward for the arrest and conviction of the person setting fire to trace elementary

school. the fire on july 5th gutted most of the school's classrooms. amazingly, the school district was able to repair enough to open the school last month at the start of the school year. >> this is another court appearance day for the man accused of ordering the murders of oakland journalist, chauncy bailey. a change of venue will take place for the former leader of your black muslim bakery and the codefendant. they are charged with three murders including bailey's. the case is too high profile and his client would not get a fair trial in the bay area. he was working on a story about the financial problems about the bakery when he was murdered in 2007. >> allow extra time to get why where you want to go. it's possible muni operators could hold a sickout today. a flyer was circulated telling them to call in sick today through friday. the union said they are not

good morning. it's time 5:14. nice and cool today and in fact the inland places like concord and livermore at about 75. we will update the traffic and weather in a few minutes. >> grown i would go in the water. a california surfer attacked by 20 footlong great white sharks. we have an interview. todd was surfing at marina state beach in august of 2007 when all of a sudden he spotted a great white shark. he managed to hold on to his surfboard after the first strike and use it to protect himself against the next attack. he punched the shark and something miraculous was happening around him. >> there were 20 dolphins and they surrounded me and they were

distracting the shark and jumping over my head while i was treading water. the shark comes back and grabs me. >> amazing and a friend helped him get back to land safely. it took 500 internal stitches and 200 staples to put him back together again. harder than huchlty duchlty. the fall is when the shark returns to the waters near the day area. >> an out of control wildfire in colorado causes more problem this is morning. nearly 1,000 acres are burning north of boulder. two homes are now destroyed. firefighters say the progress is slow, but the fire is about 25% contained. they are trying to prevent another fire like the that started on labor day west of boulder that. one destroyed 166 homes. it was contained last night. >> the effort to rescue 33 miners in a chile mine hive to

start all over again. a drill bit broke and they can't pull it out of the shaft that is 900 feet deep f. they can't get it out, crews have to drill another shaft. in the meantime, rescuers could be sending mixed messages. they drew up a program to keep them in shape, but gave them the thing they asked for the most. cigarettes. >> hillary clinton is in egypt for the second round of peace talks between israel and palestinians. it started earlier this month and clinton thinks the time is right for the two to make peace. >> caught on tape, burglars get a surprise when they find out they are not alone. check out the video from a houston sports bar. the fan was stealing big screen tvs, liquor and even the cash register. the bar manager was still in the building. he opened his office door and fired off a few rounds.

games behind the giants in the nl west standings. week one of the season is now in the books. it ended a little monday night football with a shocker last night. san diego chargers went into a rainy kansas city and the chief delivered a stunner. they beat the chargers 21-14 and they're halfway to matching their win total from last season already. >> the nfl is looking into a report that jets layers threw passes in her direction so they could get close to her. when she went to the locker room, the players whistle and made inappropriate comments. they called to apologize personally, but the association for women and sports filed a complaint to the nfl. >> your thanksgiving table could be missing a key ingredients. a pumpkin pie. that means pumpkin cropses are

rotting or not ripening. minnesota farmer has half the crop he is supposed to. in illinois where a lot of filling comes from is having the same trouble. >> we're think there will be a crop, but i think the folks at the canneries are worried about meeting demand. it will be tight. >> they will have fewer pumpkins when people are getting ready for halloween. >> 5:20 and we want to check in with mike. >> news that we may not have enough pumpkin pie. >> more whipped cream. >> fresh pumpkins and a lot of patches through livermore. a lot of cars through livermore about this time and speeds starting to dip at about the speed limit and 14 minutes and now a disabled vehicle reported westbound. the direction at greenville is mostly off to the shoulder, but

it is a large vehicle. a truck that you will need a special flatbed to get it out of the area. another crew arrives on scene to help them. watch for the slowing to continue to build around 5:30 heading over towards the interchange. that's a typical flow and typical westbound. we have the slowing around harvard. at l street where i have the sensor and that's where we see a slowing. we see a limit. you have delays and eastbound for the slow down and the two lanes blocked for construction until possibly 11:00. that will be closed until construction is cleared. oakland, 880 with an easy drive up high street at the top of your screen. you see a nice flow. flowing through downtown oakland and an easy drive across san francisco. no metering lights yet. picking up for the southbound side and a considerable slowing through the construction zone.

as governor, he cut waste got rid of the mansion and the limo budgets were balanced. $4 billion in tax cuts. world class schools and universities. clean energy promoted. 1.9 million new jobs created. california was working. i'm jerry brown. california needs major changes. we have to live within our means; we have to return power and decision making to the local level-closer to the people and no new taxes without voter approval. jerry brown the knowledge and know-how to get california working again.

>> cool last night and cool this morning and patchy clouds around the bay and around the coast. as we head towards the afternoon, the fog and the low clouds burning off earlier than yesterday. we are warming up and as we get towards the weekend, rain coming our way. models starting to pick up on the possibility for rain, especially north of the bay coming in on friday. possibly lasting through the weekend. the onshore flow helped with that. as we look up to the north, we see showers up there. that's eastern oregon into idaho. out here in the pacific, there is a system brewing and a tough coming in and that could bring us weather. we bring that forecast high as warm as 90 degrees towards chico.

way. clouds will burn off earlier than they did yesterday. this is a look at the 8:00 a.m. forecast and temperatures in the 50s across the area. we get to noon. plenty of sunshine inland that will warm up to the 70s and still staying in the 60s around san francisco and down towards santa cruz. 4:00 as promised, warmer and sunshine looks like it will invade the region. >>. >> new this morning, pieces of the pipeline are on a truck where scientists will work to figure out exactly what went wrong. the ntsb said the 28-foot piece of pipe was launched out of the ground and had several welds in it. they believe that pg&e pieced the pipe together because it had the curve to fit the terrain and one of the wells may have failed. the ntsb will interview witnesses and review a stream of documents from pg&e to figure out the cause of the blast.

>> pg&e is handing out cash to help the victims of the san bruno disaster. they gave out checks to help residents get by and help the city get become to normal. in the future, a response like this could be hampered by the agency that regulates it. today live in san bruno with a proposal that could leave rate payers holding the bag. >> whatever good will pg&e gets from a quick and adequate response to the disaster regardless of what the investigation has, it could be under cut by a discussion in san francisco today by the public utilities commission. they are floating the idea and triggering an automatic rate hike after a disaster like this one, meaning that rate payers would be footing the bill. they are calling it the wildfire expense balancing account. whatever the name, the people are likely to call it insult to injury.

proposal they back. chris sanchez, today in the bay. >> thanks a lot. a key witness is expected to take the stand in the los gatos murder for hire trial. tressa donnelly is involved in a love triangle and garcia is on trial. donnelly dated both men and dated them off and on at the same time. a coworker played them both and garcia was jealous. they believe that is what led him to hire someone to kill her on march 14th of 2008. >> efforts to bring more jobs to the east bay will get a major push. the acting governor will expedite the land agreement. it's a land development project that governor schwarzenegger said will create jobs and affordable housing and generate millions in new tax revenue. maldonado will be in estuary park to sign the agreement.

>> voters can hear what city leaders might do for the environment. the candidates for oakland mayor will answer questions on the climate and the environment later on today during a former forum on green jobs and climate action. we will talk about where they stand on better air quality and lower energy bills. the forum is at the theater from 7:00 until 9:00 this evening. >> it's 5:36 and we could get an idea of how high speed trains will travel through the south bay. the counsel is supposed to vote whether it runs underground or on a track 60 feet above the ground. the underground route is quieter and costs more. it would cost $2.5 billion. the elevated track costs 1/5 of that and takes to five years to build. it will go through the station area. governor schwarzenegger is getting ideas about high speed rail on asia today and took a

right on the bullet train. he is there to lobby the country for help building the train on its own. he moved on to south korea where he checked out another high speed train. >> the governor spent time with troops from california. we found this picture posted on his twitter account. he was shaking hands with troops that are stationed in seoul. he is scheduled to speak to them again tomorrow. smokers could have fewer places to buy cigarettes in san francisco. the city is moving closer to banning the sale and all businesses with a pharmacy like drugstores and super marks. they approved the proposal and a full board is expected to vote on it next week. san francisco became the first u.s. city to ban the sale of tobacco productions in drugstores and exempted grocery stores. >> we have been checking in with mike and watching the situation

with muni. >> a photographer is out there and we are following the story. one of the drivers came up not willing to make a comment. when asked about the sickout, he said yeah, it's not going to be a sickout. they are hitting the roads and following this for any other people's reaction. unofficial word on at least some of the drivers. no major delays and that's good news into the city. we will state muni as an alternate. the dodgers 7:15 for the game time. take caltrain or bart. no delays for those systems and a approach for the upper deck which is moving smoothly. that will start in about 15 to 20 minutes as far as a steady flow of traffic. >> over to jennifer with a beautiful view of the bridge. what do you think of that shot? >> it's lovely. as we look at the forecast, we are starting off with low clouds

president obama's plan if that's the only choice to limit the tax cuts to people who are in the middle class, $250,000 and under. those were dashed when republicans came out strongly yesterday and said we want the tax cuts extended for everyone, including the so-called rich. they say it's not about giving rich people tax cut, but about making sure there not tax increases for people providing jobs. many are in that category. interestingly at least three democrats agree and all of this happening against the backdrop of the upcoming elections. will they deal with taxes and extending the tax cuts before the end of the year before that election at the beginning of november. >> thank you very much, tracy. we will see how that plays out in the coming weeks. >> a man just fired his entire legal team. he fired the court-appointed

that rupture. bob? >> the ntsb is focusing part of the investigation on the wells that were made on the steel gas pipeline that ruptured from the crater at the bottom of glenview drive here in san bruno. investigators are reviewing videotape of the explosion. it does exist and this is surveillance video from the gas station a few blocks up the street. the ntsb said the footage will be helpful because it shows the explosion itself. it is responding to the sound and in the upper left part of the screen, there is a massive debris and a fireball. one customer drives up and to give you a sense of how frightened they were, person runs inside. in shot you can see a woman running away with her baby in her arms. you can see people running towards the fire, presume ebl to get to their hopes, cars, loved

explosion and a couple million to the city to get things back to normal. what you might know is that pg&e backs a proposal that would automatically trigger a rate hike to pay for the disaster like this one in san bruiny in the future. likely here in san bruno that is going to be received not very well by the people affected by the disaster. the public utilities commission will discuss and they call it a balancing account. in san bruno, pg&e reports they have the money to cover the did you ductible, $10 million and $10 billion in insurance related to the disaster. they could seek a rate hike to cover the additional cost. what they are discussing is triggering an automatic rate hike whether or not they would want it. this is a proposal that is floated by san diego gas and electric a few years ago after the billion dollar fires that

there will be lots of bright lights heading past greenville registering out of the pass. that's one of the westbound commutes slowing through the east bay and we look at westbound highway 4 as well. speeds below 30 for the stretch over towards about summersville harbor and things clear up. from time to time, we see slowing as well. on the other side of the freeway, eastbound is where we have the zone. two lanes are blocked and a distraction for folks. that's another area with pittsburgh over the course of the morning. we will show you south of 580 as well and a lot of folks head down and we get a live shot of the grade where the construction zone is active. when they open the lane, the volume picking up with the tail lights heading down over the hill into fremont and jennifer, we have folks heading over to the south bay and up and down for them. >> yeah, we are starting a warm up today. it got cool last night.

come into agreement. >> we are following major news oust iran this morning. definitely good news for people here in the bay area. >> one of the jailed berkeley grad students is now free. >> good morning. we know according to iranian television that sarah shourd is free. or she will be freed. technically she is still in prison. she is being processed out, this coming out of the iranian television. sarah has been suffering some health issues. the other two hikers are still in prison. shane bauer and josh battal. we talked in the past about there being a half million dollar bail that the family could not pay and the government could not legally pay because of the restrictions in doing business with iran.

it got paid according to the latest wire reports. who paid it, we don't know. sarah shourd has been released, but still inside the prison according to her iranian lawyer. she will be free shortly. >> i actually heard a report and i don't know if you have seen anything on this. somebody said they had seen her leaving and going to the swiss embassy. >> that are would make sense. the swiss have been our business partners in iran because we have no formal relations with iran. the latest wires we have is that she is still in the prison, but we have an nbc reporter in tehran. we have been in contact with the state department as well. we will hammer it out. >> sounds like big developments and major and good news. we will continue to follow it all morning for you. in the meantime, a man sits in jail accused of killing a neighbor over a speed bump. police in springfield, virginia said he shot his neighbor because the neighbor petitioned to get the speed bump installed

on the street. they had a history of runins. they were set to go to court over another alleged assault. >> a new program taught by four kids is helping a number of students deal with bullying. the teen mentor program is under way in maryland to show kids how to identify bullying and prevent it. the program is great because it teaches kids to role play and how to stop bullying. >> if we say i want to you stand up, most of the kids say what does that look like? >> experts say sometimes it only takes one kid to stop the bullying. about 85% of kids are not bullies or vehicles, but bystanders. >> an unusual protest in taiwan. protesters threw fish at japanese embassy over incidents over a disputed chain of islands. they were throwing the police at

the embassy and they are angry over the long-term plot to broaden the naval activities around the islands. two activists from taiwan sailed near the islands monday and they were expelled by the japanese coast guard at a ship that also collided with a fishing vessel last week. the japanese government insisted the actions were justified. the islands are north of taiwan, east of china and south of japan. all three claim territorial rights. there oil and gas reserves in the area. >> hate to clean up after that one. >> a new green machine to get i around this morning. any other bicycles until you look up close, the frame is made from bamboo held together with hemp fiber and resin. the bam bike was invented by someone in india who said it weighs about seven pounds less than a regular bike.

>> flu season is around the corner and using hand sanitizer may not help as much as think. a new study said using hand sanitizer is not effective in stopping the spread of common colds or flu. a lot of people say they would rather use it and be safe than sore. some people said at least having the bottles around encourages more people to be aware and be more hygienic. >> there spies in our public bathrooms and people here actually keeping things clean. the american society for microbiology conducted a survey about hand washing in four u.s. cities. in san francisco, 96% say they wash their hands. after that, the group sent spies to public restrooms and found 85% of people were actually telling the truth, much higher than the 77% in 2007. thing hasn't changed.
